Licenses, Applications and Fees

Most businesses are required to meet these requirements. Certain businesses may be required to meet additional requirements depending on the type of businesses.

  1. If you have one or more employees, or if you operate a trust, estate corporation, partnership, or similar non-individual organization, regardless of whether you will have any employees or not, you must obtain a Form SS-4, Application for Employer Identification Number, from the Internal Revenue Service, 801 Broadway Street, Nashville, TN 37203.   2. If you are liable under the Federal Unemployment Tax Act, have one or more persons employed during 20 different calendar weeks in a calendar year, or paid $1,500 in taxable wages during any calendar quarter, you must obtain a Tennessee Employer Identification Number from the Tennessee Department of Labor and Workforce Development.   3. You must obtain a Sales and Use Tax Certificate of Registration (sales tax number) from the Tennessee Department of Revenue, Andrew Jackson State Office Building, Nashville, TN 37242-1099. Phone (615) 741-2461.
  4. You must register with the Williamson County Court Clerk within 20 days after beginning business to pay the license fee and the clerk's fee ($20) at 1320 West Main, Franklin, TN 37065. If your business is located within the Brentwood city limits, you will also need to pay the same ($20) license and clerk's fees to the City of Brentwood, 5211 Maryland Way, Brentwood, TN 37027. Phone (615) 371-0060. If your business will operate out of your Brentwood residence, you will need to see the Brentwood Planning and Zoning Department with regard to a Home Occupation Ordinance. Phone (615) 371-0060. The Tennessee Business Tax is a tax on your annual gross receipts. There are some small businesses that are exempt from paying this minimum license fee, but they are not exempt from paying the business tax, the County Clerk will help you determine if you are exempt from either of these two taxes.
  5. If you have five or more full-time or part-time employees and are not exempt from the provisions of the Workers' Compensation Act, you must obtain workers' compensations coverage for all eligible employees immediately. You obtain this insurance from your local business insurance agent.
  6. If you have one or more employees, you must deduct the employee's part of Social Security taxes (FICA) from their wages, and report these deductions along with payment of your part of these taxes and all deductions of income taxes made from employee's wages on Form 941.
